Technological development has resulted in new ways that people use to misuse copyright works. Technological development plus its level of interaction with cultural products has encouraged new kinds of creative expressions. However, it has also resulted in issues that are linked to intellectual property rights (IPR). The increased application of the internet means that there will be more challenges in protecting the IPR.

Issues that are linked to new works

Issues that are linked to new forms of work include multimedia works and database. The database has been affected by the development of digital technologies. Database, in this case, is the collection of independent works, other materials, or data that are arranged in a systematic manner and which is able to be accessed electronically (Campidoglio, 2009). Digital technologies have made the development of databases to be simpler in addition to them being user-friendly when compared to the past. Traditionally, databases got protection as compilations under the literary works. However, in the computer database, there are two main parts that include the data itself and the program. The program is protected as a literary work but there are still doubts that relate to the protection of the content. The issue is there despite the Berne Convention’s provisions on compilations.

With regards to multimedia work, it is evident that digital technology has developed works with high versatility when compared to the past. Works now can include artistic, dramatic, musical, and literary elements in addition to including cinematographic film. It is also evident that users can also interrelate with the work in ways that the previous generation could not. It means that users can make alterations or changes and also develop new works from the ones that exist. If rights in every class of works were similar, then it would not be a major issue. However, many laws differentiate between the various classes of works in terms of rights. For example, the authorship can lead to other issues because its criterion is different between dramatic, artistic, musical, and literary works (Koornhof, 2015).

Issues linked to the development, communication, and distribution of work through the digital media

Digital technology has attracted new ways of developing and distributing copies of works. The transmission of work was traditionally through tape or paper such as in the case of tape, book, or film. However, this has been substituted by a material-less transmission that is through computer bytes. The right to reproduce is the basic in copyright and the Berne Convention included the right or reproduction in the year 1967. The basic copyrights are what has posed the major complications in the digital environment. The main issue is determining if digital copying is considered to be a reproduction or if the right only considers material reproduction (Bliznets, 2018). The rights to communication and distributing to the public also faces issues because of the digital revolution. The issue arises because the two rights come together in the digital world.

Conclusion

From the information, it is evident that digital technologies have encouraged the placement of technological protection measures that assist in the prevention of unauthorized use. However, there are issues that surround digital media and the implementation of copyright protection such as the issues that are linked to new forms of work include multimedia works and database. Other issues include those linked to the development, communication, and distribution of work through digital media.
