Case
The case of Morgan versus organ Motors revolves on the appeal of David M. Morgan on denying his workers compensation against Morgan Motors Company. Morgan requested the opinion and award of the North Carolina Industry Commission to review whether the Commission had errors in concluding on the plaintiff’s case on whether accidents occurred while working with the company. Morgan Motors was accused of denying workers their compensation by injuries that happened in the course of their employment with Morgan Company. The case was heard by George T. Glenn, a deputy commissioner on 7th March 2011 and 23 May 2011 and he found that Plaintiff sustained a compensation injury by accident arising out of its activities with employees while undertaking their duties. Therefore, he filed an opinion and award on compensable injury against the Plaintiff.
Facts
Plaintiff was accused of its failure to lay out a proper compensation plan for workers, and it was reviewed that the company never compensated workers who were injured during employment tenure. However, according to the defendant, he argued that the workers were not injured undertaking duties assigned at Morgan Motors Company and hence the company could not be eligible for their compensation. The different case hence needed the critical review of whether the evidence was available. On a consideration of the case, it was found that this Court’s “duty goes no further than to determine whether the record contains any evidence tending to support the finding.

Issue
Should workers in an organization be compensated for injuries even though they get the injuries out of company’s duties?
Rule
No. If workers are injured out of duty, they should not be compensated by the corporation. However, the company can give a hand in medical bill.
Reason
It is illogic to file a case against a company claims on noncompliance on compensation for workers injured out of duties. The industrial courts’ rulings do not warrant compensable injury by accident arising out of the scope of employment. Therefore, the judgment of Morgan Motors Company needs appeal and review to analyze whether the workers were injured while undertaking their duties.
