Parties
The case alleging the fraudulent misrepresentation involved defendants, Broadway Electrical Supply Co., Inc. & others and GTE Products Corporation as the plaintiff.
Issues
The electrical suppliers sought to overturn the damages that were claimed by the plaintiff to have accumulated during the years of the contracted partnership. They hoped to prove that that bargain was worth little more than what the plaintiff received. On the other hand, the defendant claimed an alleged fraudulent misrepresentation from the plaintiff’s sales representative, Bill Wasserman.

Ruling
The judge did not err in allowing the plaintiff’s post-verdict motion to establish the amount the plaintiff had proved. The defendant had not produced any evidence against the damages to state otherwise. The judge properly dismissed proffered evidence regarding the estimation of the plaintiff’s damages and instructed the jury on considering the measure of damages and the expected benefits of the bargain. On the other hand, the judge did not err in establishing evidence at the trial that was sufficient to claim that the participation of the plaintiff’s agent in the defendant’s fraudulent scheme was independent of the employer’s interest and knowledge.
Facts in the Lower Court
The defendants correctly entered the correct summary statements that showed a breach and fraud had taken place. The defendants lacked factual support to back up their summary judgment. The plaintiff had, therefore, enough reason to terminate the contract on grounds “for cause” as stated in the agreement.
Reasoning
In favor of the plaintiff’s claim, the defendant’s motions on the former’s claim were denied under the Racketeer Influenced Corrupt Organization Act. The jury reasonably argued that there was enough evidence of fraud done over a lengthy period of time. The ruling was made to precedent Laker v. Freid, 854 F. Supp. 923, 930 (D. Mass. 1994) that had several fraudulent loan activities in a period of 37 months.
