External control

The government has put in place a high level of regulation on long-term care providers to ensure that they provide quality services. The government equally engages in regulation with an aim of making sure that such care providers do not overcharge customers and those refunds to the care providers is in line with Medicare and Medicaid provisions. The government ensures quality requirements are followed by measuring the process of care delivery, structure, and outcomes. Some of the agencies that regulate these care providers are federal governments, state and local governments.

Law versus regulation

A law is a guideline that is developed through the legislature, which indicates what people are expected to do or not does and specifies the consequences of breaching. The legislature develops bills that once passed becomes law. It indicates the legal requirements. On the other hand, regulations are guidelines that are used in enforcing the law. Regulations are rules and standards that are developed by administrative agencies indicating the process of enforcing the law. An example of law is Expanded and Improved Medicare for All Ac t that provides US Citizens with health care and an example of a regulation is the HIPAA Privacy Rule which protects patient private information.

Licensure versus Accreditation

Licensure is a document indicating local codes. On the other hand, accreditation refers to the certification offered to organizations to indicate that after carrying out assessments it was noted that the organization has implemented all of the set codes and standards in its operations. For instance, licensure may be issued to a health facility to operate but accreditation may be issued to indicate that the health facility has complied with Medicaid requirements

Problems in government regulation

One of the problems is lack of coordination of regulations with different agencies developing different regulations for different purposes. Some of these regulations are duplicative. Equally, emphases in regulations have been on the consumer with limited effort to enhance the well-being of the care provider. For instance, Medicaid boost access to care by patients but no improved capabilities of care providers to provide service
