One of the hardest roles in criminal justice is balancing between ensuring public protection and safety and protecting individual rights. The most difficult situations involve gun control legislation, the death penalty, and the government's collection of metadata.

The eighth amendment of the constitution emphasizes individual protection from the excessive bails and punishments enforced by the government. In this case, the death penalty, which is often applied in capital crimes, seems to violate the law- the sentence of often considered cruel and unusual. Another topic of great controversy in the United States is on gun control and ownership. On one side, there is an argument that the government should pass legislation to protect the public by limiting access to weapons. On the other hand, it is argued that the government should not infringe on citizens' right to own a gun as provided in the amendment. The balance between protecting the individual from unreasonable search and ensuring public safety is another critical issue. The National Security Agency (NSA) is said to violate the fourth amendment that protects individuals from unwarranted data collection. Nevertheless, with the terrorism attach that occurred in 9/11, America has sought to remain vigilant and therefore collect metadata that might help in identifying any suspicious individuals in the country before they cause harm.

Violence in Health Care and Criminal Justice

Violence tends to be defined differently in the health sector and criminal justice. In healthcare, violence is considered a hindrance to national health. Violent behaviors among people are associated with environmental, biological, social, and systemic stressors. In healthcare, violence is prevented through decreasing individual exposure to known factors. Public health has been successful in involving actors such as the community, private entities, medical organizations, and social agencies to reduce violence through education and the provision of counseling. This has decreased the need for criminal justice drastically in applying the punitive actions on the offenders who endanger others by engaging in violence.
