Eileen’s actions are categorized as vandalism. However, in this case, there are two factors that I will consider in my argument in Eileen’s defense. First, I will consider her criminal history. From the profile above, I want to assume that Eileen has no criminal history as she is an artist. She is a concerned citizen, worried about the dilapidated state of her neighborhood. Eileen has no history of vandalism of any nature, and this crime is her first violation of personal property ( Young People Legal Rights Center, 2020 ). Secondly, I will consider the harm that her actions have caused the property. As stated, the house is dilapidated and ‘in need of a paint job.’ Eileen’s response was thus, unsolicited, but there was relatively no harm done to the warehouse. Instead, it was decorated with a beautiful mural. In her assumptions, Eileen thought that her artistry would improve the appearance of the warehouse. However, her actions are not interpreted in legal terms, as in her social perspective. I would argue that Eileen deserves to be warned, not punished, and made aware of private property invasion and vandalism.
I think the case will end in three possible outcomes: first, the case may be dropped on the grounds that Eileen’s actions were out of ignorance but nobble. The arrest and arraignment may be considered punishment enough, and she may be warned of severe legal action if she is found guilty of the same charges again ( King, 2019) . Secondly, the case may end in an informal adjudication. Eileen may be obligated to perform community service or informal probation, upon which the charges will be dropped. Lastly, the case may end in formal charges where Eileen may be charged with vandalism according to the state regulations ( King, 2019) . However, I believe that in this case, the case will be dropped based on Eileen’s noble intentions and lack of history of criminal acts.
