What is the H1-B visa? 

This is a visa in the United States' Immigration and National Act department, section 101, which provide chances to the U.S employers to temporarily employ foreigners to work in specific occupations (Chakravorty, Kapur, & Singh, 2017). A requirement of exceptional ability relative to the department of defense, cooperative research and development also play a part in the visa. 

How do you apply for it?  

The application starts from finding a US sponsor by the US employer. The employer then submits to the labor conditions application for approval with a form 1-129, and lastly, the applicant completes an application at a US embassy through petition as a nonimmigrant worker.

Why do you think the H1-B visa has recently become under attack? 

The attacks have been accelerated by the reports of abuse by the outsourcing companies and the critiques from Donald Trump's administration. Trump's administration claims that business uses the visas to suppress the American workers with cheap foreign labors such as from Indians who started migrating to the US since the early 20 th century. 

  What group(s) has been advantaged by the H1-B visa? 

The visa has been an advantage to the foreign workers who are employed in the country, the students who benefit through scholarships and remain filtered into the US (Luong & Juang, 2016). The US employers also benefit from the cheap labor acquired through the visa. Also, immigrants such as Indians have been a good contributor to the US economy with about 10% to 20% tech star ups as of Indian origin.

6. Who is this visa open to? 

  The visa is open to the trainee who seeks further training in many fields of education apart from the graduate medical education. Such training may not be available in the foreigner's home country (Bray., Link & Nolo, 2017). The visa also applies to special education exchange programs especially in areas of specialty in educating children with disabilities.

The visa has helped individuals who have been invited or sponsored to train in the US and the individual education visitors, both trainees and trainers asked the US. 

How old is it? 

The visa runs for two years of stay in the US for trainees and 18 months for special education programs and runs without extensions unless through petitions to the USCIS to change status (Bray., Link & Nolo, 2017).

The main obstacles that can deter someone from getting a green card include factors such as failure to handle all the application requirements, inability to claim because of inadmissibility or even having no basis, under the immigration rules to access the green card (Luong & Juang, 2016). Finally, an H-3 visa holder can get a green card in situations such as job qualifications in the US, but through a legal channel with the involvement of a well-versed attorney on matters immigration. The legal process follows a petition to the USCIS.
