This module is focused on helping one to relate negligence and malpractice in the healthcare setting. From the module, it is clear that negligence and malpractice are closely related considering that malpractice is a negligent actor the failure by a professional to act (Guido, 2014). The module provides the example of negligence in the case of a patient who developed edema, phlebitis abscess, nerve damage and a chronic wound at the IV infusion site. The reason for this negligence is associated with poor communication between the nursing staff and the communication. This example falls within the six criteria that are used to establish the occurrence of negligence in a healthcare setting. The six criteria that the patient’s family used to sue the hospital for negligence includes a duty owed to the patient, breach of the duty, foreseeability, causation, injury, and damages. The module ties each of the six criteria to the scenario thus helping one to understand the concept of malpractice and negligence in the IV therapy practice.

This module sets off by giving a concrete definition of negligence as the failure to take steps aimed at preventing injury or loss to another person. From the definition, it is clear that negligence is mostly deliberate as health professionals know how they ought to deal with their patients. This post reiterates the KS modules elements of negligence, which are used to establish whether there is negligence, or not. Those elements are a duty owed to the patient, foreseeability, a breach of duty owed to the patient, causation, injury, and damages (Guido, 2014). The module offers the example of an elderly and incontinent patient with a stage IV sacral wound, which remains dirty for days. While the emergency healthcare workers know the condition of the patient, they fail to clean the patient exposing him to unhygienic conditions, which worsen his condition. Technically, such negligence can lead to skin disease or increase the risk of acquiring pressure ulcers. The module concludes by calling upon healthcare professionals to work within the confines of ethical provisions to improve the wellbeing of the patients in their care.
