Regarding the penalties to be issued on the suspects, it will vary with each of the suspect being responsible for his or her own offence. When a person is in violation of Code Sections 16-8-14 part (b) and number (2), he will be punished by imprisonment for not less than one nor more than ten years because he is convicted of an offence of theft of property that exceeds $300.00 in value. Such will be the penalty issued on the first suspect (Taylor, Fritsch & Liederbach, 2014). Therefore, the first suspect will have a felony shoplifting conviction since he stole goods of a value more than $300. The second and third suspects will punished as for a misdemeanor conviction because they shoplifted a product of less than $250.00 in value. Also, they can be charged for theft by violence based on how the first suspect pushed the security officer until he fell to the ground (Taylor, Fritsch & Liederbach, 2014). . Task 2
Considering the crime scenario, the crime committed was done by young professionals. On the other hand, the description provided by Hellman (1970) and Stirling (1974, p. 120) as shadow professionals could also fit this scenario. The three suspects could assumedly be people who in a vocational way add to their lawful incomes by shoplifting merchandise from stores. Nonetheless, the three suspects will still be falling under the amateur level because they act more like snitches than professionals. For instance, upon entering the store, suspect one took three dozen pairs of the Big Guy brand socks and places them in his pants. The second suspect also placed two dozen pairs of the Hang Nail Free brand of socks into suspect three’s purse. These two moves appear to have planned as they knew where to place their goods once they had stolen them. A professional criminal plans ahead before he executes a theft plan or what could be termed a modus operandi and an exit for his loot. For example, once the suspects were confronted, they ran out of the store into the back parking lot of the store. The value of the goods that they had taken also reveals that these suspects were gangsters and could not just be satisfied with small merchandise that will not generate to them good money. Also, there act of running could also speak of their professionalism in theft. An amateur may not have thought of running but would rather be freaking and shaking out of guilt. Therefore, there act of running as well as that of the first suspect bumping on the security officer to a point that causes him to fall to the floor must have been intense. These qualify them to be professional thieves. A professional has a compromised moral capacity and he cares less if the victim is not hurt. For example, the first suspect ran into the security officer and bumped on him with a thud that caused him to fall to the floor. The suspects must have been considered as outright professional because of how they were seized by incarceration.
Task 3
The type of criminal typology portrayed in this scenario is that of shop lifting. Factually, goods have been hidden by the three suspects and had disappeared from the overall accountable inventory. The first suspect took the socks and hid in his pant, while the second took the goods and concealed them on the lady’s pocket (Shiller, 2016). The store must have been in a large retail chain with socks displayed in a more appealing manner that captured the attention of the suspects. The display of the socks on the shelf caused a great opportunity for the suspects to steal them. In fact, if it were not for the security officer seeing the suspects, they must have prepared even to lift more items from the store (Shiller, 2016).
The three suspects together lifted products worth $672 from the store. The first suspect took socks of $432 in worth and the second and third suspect taking socks of worth $240. In fact, the three suspects fall under the category of professional shoplifters and not just snitches (Taylor, Fritsch & Liederbach, 2014). They had carefully planned and were skillful on how they hid items they had stolen. They took expensive items which they could easily sell to retail shopkeepers who need to be supplied with such products. Again, it is confusing to understand the motivations of the suspects in this scenario (Schmalleger, 2017). One of the suspects is employed in a metal stamping job. They probably shoplift to supplement their income. They seem to be getting enough from their work stations or they are not just satisfied with their income.
This kind of criminal typology may not be considered seriously in a society yet it is so detrimental (Schmalleger, 2017). It may even be perceived not to be a serious one yet it amounts to a lot of losses in many stores in Georgia. The suspects in this scenario may also be charged with burglary, which is a form of shoplifting. Burglary entails the unlawful entry to a store with the intent to commit a theft or felony. The three suspects had intended to get to the shop and steal without being noticed (Taylor, Fritsch & Liederbach, 2014). The falling of the security officer on the ground was not as much as an act of defense for the first suspect, but he just bumped on him. The suspects wanted to be smart with their operations of shoplifting but they were interrupted by the security officer. It was possible for them to have taken more items if at all they were not spotted. Therefore, this scenario is a typical case of shoplifting.
