ntroduction 

The Kansas Constitution is the primary and legal governing document for the state of Kansas. It specifically documents the parameters and the role of the state’s government. The constitution was last revisited and ratified on October 4, 1859. The paper shall be comparing the Kansas State Constitution with the US Constitution. The focus will be on the similarities and the differences in government and document structure. The paper contrasts the bill of rights with particular emphasis on the right to privacy. 

Government Structure 

Both the Kansas Constitution and the US Constitution acknowledge a governance structure which comprises of the Executive, Judicial, and Legislative. However, the heads of the different arms of government vary due to the bilateral government structure of Federalism. The Executive in the Kansas State Constitution is headed by the Governor as compared to the President as per the US Constitution. The responsibilities for the different leaders remain the same. A fundamental difference is that the US Constitution accords the executive the power to print currency, declare war, and sign treaties a provision not made for the executive as per the Kansas State Constitution.

Document Structure and Language 

The US Constitution consists of a preamble and seven articles as compared to the Kansas Constitution which consists of an ordinance and preamble and 15 articles. Both constitutions contain the Bill of Rights. The Bill of Rights protects equal rights and the right to peaceful assembly which is similar to the First Amendment rights. The right to trial by a jury in serious crimes is in accordance with the Fifth Amendment Right. The right to habeas corpus, the individual right to bear arms, and the right to privacy all consequently correspond with the Amendments in the US Constitution. The language used in both the documents are written in legal jargon so as the constitutions are legal documents for governance. 

Right to Privacy 

As per the Fourth Amendment of the US Constitution and as per the Kansas Bill of Rights, the right to protect one’s self or property from unreasonable searches shall not be breached unless with a warrant that shall be issued only with the establishment of probable cause. The purpose is to provide privacy for all citizens as per both the US and Kansas states Bill of Rights.
