In some organizations, most of the managers are confronted with the task of addressing several of the presented issues that are related to HR on a day to day basis. In this case, it becomes necessary for them to seek the relevant advice from the HR professionals. However, some the new managers are faced with several challenges that range from the inability by the smaller organizations to separate the human resource department and to have a centralized point of operation. It is related to this case study where Eli, who is a new departmental manager at one of the manufacturing plants, can observe certain deficiencies that are related to the handling and the management of the human resources at the firm. 

The first concern is that there is no centralized HR department. For this reason, most of the functions of this department have to be shared among the many operations managers. This means that as one of the new people in the organization, he has managed to spot some of the things that those who have served for long have not been able to spot simply because of the way with which they are used to do certain things.

Before the meeting with the supervisor, Eli will need to understand some things about the labor laws and the employment laws that are set up to ensure that the employees in any organization are provided with favorable working conditions. For instance, in this case, based on the absence of the labor laws on the part of the production employees, there will be a need to establish a labor union. With this, it will be possible to lay down rules of the provision of the workers with sick leaves as well as compensation in case of any forms of injuries that are attained at the work area. Therefore, it will be vital for Eli Fares to explain the need for the formation of a labor union to the plant manager in the effort to explain its tasks and roles in the representation of the workers at the factory. In this case, one of the processes that he will need to understand include the process with which a labor union can become the only representation of the bargaining unit of the junior employees within any organization. In essence, one of the primary tasks mandated on Eli includes the idea that a union acts as the exclusive form of representation for a bargaining group which is, in particular, a group of similar positions. In this case, it will act as the representative for all the workers who are involved in the west side of the building. This is mainly the production area that is not equipped with the proper working conditions when compared to the east side that is primarily composed of the management personnel. For instance, there is no right ventilation and heating equipment in this area. Also, poor conditions are offered to the employees especially about the ability to take time off and to make compensation claims. In this case, the labor union will act as a representative for all those employees holding those positions. Therefore, it will possess the mandate regarding the authority and the exclusive right to negotiate with the management about their working conditions and other related benefits. The process leading to the formation of such a labor union will include the collection of sufficient authorization cards from the employees in the bargaining unit. This will mean that it will have to collect more than 50% of the cards from the production employees in the West unit to be in a position to represent their well-being in the work environment. 

The presence of a union organization in any organization creates a certain number of limitations for the management of the firm. This means that they can be allowed to take part in certain activities while they are prohibited from taking part in others. For instance, in this case, it is vital for Eli to understand that the availability of a labor union to represent the activities of the production employees limits the chances of discrimination against the employees at the firm. In particular, it ensures that the proper working conditions are placed and maintained at each of the departments in the firm. Also, they will make sure that the rights of each employee regarding benefits and compensation are upheld at all times. 

The formation of such a labor union will reveal the idea that the company faces some liabilities from the legal perspective as well as from the risk management perspective. This is mainly brought about by the discrimination that is seen between the two levels of management as well as the conditions and prohibitions made towards the production unit of the firm. This is also contributed to the fact that the company is large enough to divide its human resources responsibilities to handle the diverse needs of its employees at different levels.
