Stalking can include normal activities like sending flowers, cards, or candy. However, the everyday activities turn into stalking when the victim, receiver, is not interested in the gifts or any contact with the sender, who still insists on sending more. Stalking can be described as a pattern of harassing and threatening behavior directed towards an individual to frighten and intimidate the victim. The behavior can include a constant appearance at a person's home or workplace, following, making threatening calls, writing threatening messages, and vandalizing the victim's property. Statistics from the National Coalition Against Domestic Violence indicate that about 80% of women killed by their partners were first stalked. Stalking has grown to become one of the major social problems in American society, which calls for immediate interventions. Purposely, the paper intends to discuss the criminal justice system's challenges and the victims in responding to stalkers.

Staking cases have proven to be extremely challenging for the criminal justice system, which has resulted in low conviction rates for stalkers and high frustration for the victims. Among the challenges faced by the criminal justice system while tackling stalkers is the lack of concrete evidence to prove their actions. Other than the vandalization of property and the availability of threatening messages, victims find it impossible to prove other stalking activities, making it impossible for police officers to arrest and charge the culprits with stalking offense. Another challenge the criminal justice system faces while dealing with stalking is that stalkers are unpredictable since they have their unique wants from their victims. Therefore, taking legal actions without knowing what stalker desires can escalate their behaviors to become violent and harmful.

The lack of proof confirms that being stalked is the major challenge that victims face while dealing with stalking. Therefore, a victim can report a stalking incidence, but without evidence, the stalker is not apprehended, which leaves a platform for an escalated stalking behavior. Although they can be provided with restraining orders, a stalker will find a way to bypass the order to continue tormenting the victim into accepting his demands.
