Executive Summary

This is an investigation report concerning conducting personal responsibility during government hours. The investigation was initiated following Mary Marshall's call, who is a DOT employee and a member of GLUE to the OIG on the 7 th January, 2008. The call is to inform the OIG about the site manager (Jarry Jason), who conducts personal work during the government work. The allegations raised were Jarry Jason acts as an ordained minister of his church and actively participates in a political organization. Mary Marshall further indicated that Mr. Jason had conducted counseling sessions in his office and other paper works. She further indicated that Rhoda Richards, Jerry Jason's assistant performs political work during her government work. The investigation was initiated by surveillance for two days; after that, interviews with the employees were conducted. From the surveillance, Jerry Jason and Rhodah Richards did not spend their entire day at the facility but visited other places. Bernie Brown is also involved in the investigation as he is seen with Jerry Jason at a restraint. The interview with Rhoda denies Mary Marshall's allegations that she is engaged in conducting Jerry Jason's personal issues by indicating that she was out for official duties. However, she agrees to type church-related documents on Jerry Jason's laptop and asserts that confidential records are kept at the office desk. Bernie's interview indicates that he is forced to contribute to political fundraisings, and he had given Jerry money in the presence of Rhoda Richards. The Jerry Jason office searched confirmed the availability of some church and political documents and soft copy documents on the laptop. His laptop also had controversial nude images, which he did not want to talk about. Jerry denies engaging in any personal business during government hours but during his lunch break. Engaging in personal business during government hours is gross misconduct.

Investigative Report for the Department of Transport Employee

The report is based on the investigation findings undertaken together with Frank Friendly, a sworn investigation officer, investigator Carl Crawford, and investigator Tunny Thomas. The investigation was prompted by a call from Mary Marshall, an employee of the transportation department and a member of GLUE. She alleged the site manager Jerry Jason was engaging in misconduct during working hours. The specific actions are counseling church members, distributing political papers, engaging in church paperwork in his office, and using DOT laptop computers for his duties. She further indicated that Rhodah Richards, who is his assistant, is being compelled to engage in the activities and might be intimidated with a fear of loss of employment.

An interview with Mary Marshall was scheduled for 15 th January 2008 following her indication that she will be leaving for a four-month holiday in Europe. During the interview, it is revealed that Mary Marshall was Jerry Jason's assistant and was forced to engage in his business during working hours. She identifies that she used to type political organization documents for him, and she was transferred when she stopped. She further indicated that she had a romantic relationship that ended when she confronted him about the issue. Mary Marshall mentions Bernie Brown, a contractor attached to the DOT and aware of Jerry Jason's political activities. She says that she heard that he contributes to the political candidate endorsed by Jerry Jason to maintain the contract with the DOT. Mary also mentions that her friend Rhoda said Jerry has a gun he uses when he visits a dangerous neighborhood. She ended by indicating that she does not want to be involved but was convinced that Jerry Jason was wrong by engaging in personal responsibility during government hours.

After the interview with Mary Marshall, surveillance of the facility was done on 17 th January and 18 th January to monitor the people's activities. The facility is located at 234 North Elm Street, and the facility has three assistants, one office manager, and the site manager (Jerry Jason). They all turn up for work before 8 o'clock but at different times. Activities are monitored where Rhoda enters Jerry's office on different occasions. Jerry Jason and Rhoda also left the facility at 7:50 am, which prompted the use of moving surveillance. They arrived at the Carlson governor campaign office located at 449 North Elm Street at 9.00 am. They spent their 45 minutes when Jerry Jason exited the facility. Rhoda exited 15 minutes later and walked north El street, where she later entered 734 north Carlson governor camping office. Jerry Jason had headed to the church at 4321 Monroe Street. He left the church at 1:15 pm and headed to 734 North Elm Street to pick Rhoda, who left the building with a box and placed it in Jerry Jason's car trunk. They both left for McDonald's restraint, located at 627 North Elm Street, and checked in at 1:45 pm. On their exit, at 2:50 pm, and entered the car. They were joined by Bernie Brown, who engaged Jerry Jason in a conversation and handed him a white envelope containing money. Bernie Brown returned to the restraint while Jerry and Rhoda drove to 234 north Elm Street, where the DOT is located, and returned to their respective workstations. At 3:15, Rhoda exited the facility and drove away in the car she reported to work with later. At 4 pm, Jerry also left the facility and drove away in his car, and the surveillance was terminated at 4.02 pm. On 18th January, the surveillance was launched at 7.00 am; they all checked in before 8 am. At 12:15, Bernie Brown left the facility and drove away in his car; Jerry arrived at the church at 1:15 pm while Rhoda arrived at the Carlson governor campaign office located at 735 north elm street. Later Jerry arrived at 449 North elm street Carlson governor's campaign office and was lost from the vire. At 1:42, Bernie Brown arrived at 449 North Elm Street, exited his car, and entered the office carrying a manila paper.

The surveillance was followed by an employee interview. The interview with Rhoda was held on 21 st January 2008 at the OIG office at 2:30 pm. Rhoda confirmed that she had seen Jerry on different occasions conducting personal duties in the office at 234 North Elm Street. She indicated that he also conducted counseling sessions with the parishioners in his office. She further agreed that Jerry had asked her to type political documents during working hours. She denied having seen Bernie at the restaurant nor him giving Jerry money. She indicated that she went to the Carlson governor's campaign office to perform official duties.

The interview with Bernie Brown occurred on 21 st January 2008 at the OIG office at 4:30 pm. Bernie Brown indicated that he was an ABC company computer consultant. He indicated that the company had had a government contract for the past five years, and it has earned them good returns annually. He indicated knowing Jerry Jason at a personal level and suggested that the relationship has contributed to the earning of the contract. He agrees to funding some political candidates as well as purchasing fundraiser tickets to enable him to maintain his contract with the government. He indicated that the sum of $800.00 was handed to Jerry at Mcdonald's restraint, where Rhoda witnessed.

The interview with Jerry occurred on 22 nd January at 234 North Elm after the search of his office. The search had revealed the availability of political and church documents, both hard copies and those saved on the laptops. The laptop also had nude photographs of school-aged boys. Jerry admitted that he was a church minister; he handled financial documents and offered counseling and an officer at a political organization. He indicated that he has never forced any employee to participate in political activity. He said that Rhoda was a volunteer of the political organizations, and he was not aware if he does political activities during work hours. He mentions Mary Marshall as a former volunteer who was transferred after he confronted him about doing political organization work during government time. He denies doing personal responsibilities during government hours but during lunch break. He accepts going to the McDonalds restaurant on the 17 th but denies it. He also stated that he kept his political and church document in his suitcase and thus not aware of how the document reached his drawers. He refuses to proceed with the statement without his lawyer when asked about the events of 18h January.

The actions of Jerry Jason contradicts the DOT regulations of section A, B, C and D thus he is liable to the suspension, termination of duty or pays cut. In relation to the criminal statutes, Jerry Jason is liable to charges as stipulated in penal law sections 200, 200.10, 200.30, 200.35, 265.01, and xxx. xx. This is as a result of engaging in political activities, allowing Rhoda to be a volunteer, taking bribes from Bernie Brown, having pornographic images of minors, possessing a firearm, and influencing contract allocation because of the anticipated benefits.
