Sterling Inc. and NoBugs are currently experiencing a stand-off where the latter does not agree with the former’s valuation of loss incurred due to the explosion. In this case, Sterling Inc. should prompt its litigation attorneys to conduct a thorough assessment of the initial case as they gather evidence of the appropriate action to undertake. This will help determine if there is enough evidence to file a lawsuit. If the NoBugs Corporation refuses to make a settlement to resolve the conflict, the company’s attorneys will commence the lawsuit by drafting summons and complaints. The attorneys should also draft various motions including motions to dismiss, strike, or amend. The process of discovery will then begin, which will offer both parties an opportunity to present their case for or against the other. The process will include cases such as interrogatories, depositions, requests for admission, and requests for production. This information will be gathered in the pre-trial before the commencement of the lawsuit. 

Litigation is an effective process of developing measures that will ensure smooth resolution of the conflict between Sterling Inc. and NoBugs. There are both advantages and disadvantages of using this process. For instance, the process is advantageous as it follows a clear procedure and presentation of evidence that will help achieve a suitable settlement. The formality of presenting evidence and disclosure of information helps the two parties identify effective measures of realizing a common understanding. The final decision made is by the judiciary which provides an open system of justice. It is evident that the corporation will receive a fair trial. However, some of the arising issues include the extensive time spent in various motions, the high cost of paying attorneys throughout the process, and it is less likely that the parties will come to a resolution without commencing the lawsuit process.
