Sobriety Testing in the Criminal Justice System

The sobriety test has three ways of carrying out tests which include the walk and turn test, one leg test and the finger to nose test (Nelson, 2015). Moreover, the sobriety test like walk and turn test are not an effective way to judge whether a person is on drug or not. This is because some of the people might be misjudged to be drug yet it is their nature to portray some behaviour. An example is that the eyes of some people just behave in a way that the nystagmus occurs in fewer times (Nelson, 2015). This makes the police judge that if the consequently, other police officers are not trained to perform the test yet, they do it by copying what they saw their colleagues do making the methods ineffective. 

On the other hand, the sobriety test main benefit is that it creates no harm to the person who is undergoing it. However, it has its drawbacks which include that over 77% tests carried by the police, 23% of them are found to be wrong (Nelson, 2015). Additionally, different conditions can lead to failing the test if they are not in the set parameters set by the NHTSA (Nelson, 2015). Moreover, due to some physical conditions of the body, one can easily fail the test. The other drawback is that many officers make mistakes while evaluating the test. Hence, this leads to the failure of the test been carried out 9Nelson, 2015).

According to my new found knowledge on ethanol, I have realized that the standardized field sobriety testing program cannot be used alone to determine the soberness of a person. This is because someone can fail the test due to body problems an example been weight which makes for them hard to stand on one leg (Nelson, 2015). Additionally, some people are physically healthy but have the problem of stability in nature. Thus, this leads to them failing the sobriety test.
