The delivery of case management services by the public health nurse differs in several fundamental ways from those delivered by the traditional nursing care performed in hospital nursing. First, the nurse case managers provide the care with an emphasis on coordination, utilization of resources and management of finances to achieve the desired health outcomes cost-effectively while ensuring the provision of care in a less restrictive setting (Joo & Huber, 2018). Second, the case managers work directly with patients with disabilities and chronic illness as well as their families and loved ones normally in the home setting. The case managers play the role of liaisons with health insurance service providers as well as healthcare service providers in the management of medication, development of care plans and researching of treatment opinions (Weierbach & Stanton, 2018).
There are two major unique legal issues faced by nurses in providing case management or home-based care services. These are the patient's right to choose their healthcare provider and the use of Electronic discharge systems. In regards to the patient’s right to choose their healthcare, the law guarantees patients and their families the right to choose their healthcare providers but in most cases the nursing case managers take up that role and work in together with healthcare service providers to recommend clients to them for kickbacks (Maharjan, 2019). In regards to the e-discharge systems, the case managers work together with specific healthcare providers in the discharge of the patients for kickbacks while the healthcare providers benefit from getting compensated by the patient’s health insurance providers. These legal issues can be overcome by nursing adhering to their professional ethics code and sticking to the Hippocratic oath to above all put the benefit of the patient before their interests.
