Over the past few years, the U.S judicial department has been having numerous discussions regarding outside forces influencing the federal judiciary. The judicial system is essential to the country in ensuring that the law is shaped accordingly without threats or intimidation from any other party. In other words, judges need to be free but at the same time obliged to decide on their own. According to Siegel, Schmalleger, and Worrall (2018), the court system's functions include upholding the law, resolving disputes, protecting its citizens, and reinforcing social norms. The legislature's political influence and dependency on budgetary issues have made the judiciary a tool for conducting agendas of special interest and corporations (Root, & Berger, 2019). Therefore, until the judiciary is set free from political influence, then the people of the U.S cannot rely on the courts to make independent decisions, and most Americans will be prevented from accessing the courts at all. Societies cannot function and act responsibly without laws and regulations. Additionally, people require courts to prosecute and get justice. The constitution is the major source of law in the United States and generally identifies specifics that limit government authorities. The primary role of the U.S Supreme Court is interpreting and expounding all congressional enactments that are brought before it in an appropriate way according to the constitution (Siegel, Schmalleger, & Worrall, 2018). Additionally, it has the full power of examining both federal and state statutes and executive actions in determining whether they are in respect to the U.S constitution. The indirect forms of control that ensure an independent judiciary include confirmations and budgeting. In terms of confirmations, the senate is the one that decides who becomes a federal judge, and this might be detrimental since politicians can easily influence the judges (Friedman, 2019). Some of the U.S Supreme Court's political pressures include threatening a judge's life and publicly criticizing the judge's decisions when they rule against them. In conclusion, the interesting and worth noting point is on judges' election since that is the base of everything that happens in the courts. This point is of major interest because it serves as a chance for voters and the public to exert control over the judiciary. The voters have the chance of electing the judges that are fit for that position and ones who are more likely to address their issues. As food for thought, does the act of electing judges like politicians affect how they make their decisions?
