How the Constitution Affects Healthcare Policy

The constitution is the supreme document in the country that dictates how everything is run or governed. It determines the agencies that the federal government can create and the services that it can provide to its citizens. Different sections of the constitution allow the government to provide different services to the citizen. When it comes to creating, regulating and mandating healthcare policies, section 8 of the constitution provides a directive on what the government ought to do. 

Section 8 indicates that the federal government can shape service delivered to citizens across the entire countries through policies and regulation it crates through Congress. In this regard, the Congress is the main entity through which the government can shape the health care policies and mandates. Indeed, in the various past presidents have made efforts to shape healthcare policies through the help of the Congress. The most famous of these initiatives was the Affordable Care Act, popularly referred to as Obama care which sought to make healthcare affordable to all American across the country.

Another recent effort at shaping the healthcare policies through the power given to Congress by the constitution is the effort by President Trump to repeal Obama care. According to a recent article by Jacob Pramuk, “Trump is trying to kill Obamacare again, and Democrats couldn't be happier” published by CNBC, President Trump has made several attempts to have the congress replace Obamacare with a new health policy with little success. Mainly, the Congress is divided on this issue. The Democrats support Obamacare having voted and passed it during President Obama’s administration. On the other hand, the Republicans on their own are not able to marshal the number required in Congress to change the laws. 

In a nutshell, Congress consists of members elected by the electorate to represent them and act on their best interest. Their mandate comes from the electorate, and since they do not desire a backlash by the electorate, they are torn between representing the electorate and supporting the Whitehouse. Thus, this support of the health policy or lack of it is a product of many issues beyond their own choice.
