The competence that Gellene had must have been associated with concealing some of the critical information during the court cases. Despite having an opportunity to disclose the information after his errors were exposed, he could not confess since it could destroy his reputation as a lawyer. Gellene acted unethically during the court case because he filled a Chapter 11 bankruptcy petition and even took an oath to outline any potential conflicts of interest that might have resulted in the process. However, Gellene decided to withhold information on the Milbank Tweed representing South Street and Salovaara concerning the issue. Gellene must have kept the information for his own interests so that he could win the case against his opponent. Gellene did not consider the mistake he was making by lying under oath and withholding information that affected the decision that was made in the court ( Prentice, 2018) .
If Gellene admitted his errors openly, it would be showing that he was unreliable and lied knowingly. It would be reducing his chances of getting other court cases due to his dishonesty. It would compromise his entire career. Gellene admitted that it was stupid of him not to stand and admit his mistakes. If Gellene has been a lawyer with integrity, he would have defended his position and his career. After the mistakes were brought to light, Gellene should have admitted that he did not report on the conflict of interest. Gellene could defend himself indicating that such information would have compromised the defense for his clients. Gellene can as well indicate that he did not consider the implication leaving out such important information would cause to the decision. Because of his silence, Gellene ended up in jail for fifteen months.
