With a clear understanding of the best alternatives in negotiation, creativity helps to open doors for collaborative options that can lead to mutual gains rather than losses. Through a creative response negotiation strategy, the stakeholders can choose the most appropriate BATNA for them. A BATNA is a set of criteria reminding stakeholders what negotiated outcomes they find satisfactory (Pinkley et al., 2017). As such, the strategy not only helps the two conflicting parties come to terms, but it also brings satisfaction to the stakeholders through the creation of harmony and unity.
After the promulgation of the Kenyan Constitution in 2010, the country has been pushing for the use of Alternative Dispute Resolution (ADR) techniques in the management of conflicts throughout the nation (Kariuki, 2015). As a promoter of a peaceful and just society, a creative response negotiation strategy is one of the ADR techniques that can be helpful in the negotiations of conflicts in many Kenyan business organizations. Through creative negotiations, institutions, policies, and relationships are at a better place in sustaining peace and harmony. In the end, there would be development and fairness for all without interfering with cultural, political and economic aspects of the country.
