Legal and Moral Right to own a gun

Guns are a big part of the society in the United States and the law through the Second Amendment allows for firearms bearing and keeping. In some states, the law grants a right to employers and property owners to forbid having a gun in a car while in others the law prohibits an employer from restricting employees to have a gun in the car. In the United States, there has been series of killings resulting from guns use, and therefore it is essential to consider the rate at which guns are owned, who owns them, the violence resulting from firearms as well as the laws that permit the ownership of guns while coming up with gun policies. In this paper, I will analyze a case study on having a firearm traveling to work and give my opinion on whether it is moral and legal to have a gun in a car while in a privately owned property. The paper will also discuss on whether the legislature is allowed to interfere in employers decision regarding firearms as well as the circumstances that could lead to an employer allowing guns in both the working place and in the cars in the parking lot.

The Second Amendment in the United States allows an individual to own a gun legally. I believe that there is a stronger and fundamental law that needs to be made for the ownership of firearms as a moral right (Shaw, 1, P. 312). As a citizen, I believe that I have a right to own a firearm. I should be able to protect myself from any threat or danger legally. Naturally, the moral right to own a gun is natural because everyone possesses the right to life protection. The right to life entails the right to defend oneself and hence, in turn, a right to the means of defending oneself. Owning a gun is the most reasonable mean in which I can protect myself; therefore, there is a moral presumption favoring ownership of firearms privately.

A right to life entitles us to do anything to protect it. A right to life is a moral shield that protects an individual while pursuing fulfillment in life and provides them with the protection by carving the ethical space that other people should respect may it be through not interfering or through providing them with something positive. Having a right to life I am entitled to exist individually, and my life should not under any circumstance be taken away without reason accepted morally.

The right that I have to live forms the bases for all other rights, such as the right to ownership. I, therefore, have the right to own a weapon that can help me protect my life and that entails a right even to use force to do so (Shaw, 1, P. 312). Guns are good weapons that can effectively, reliably, and practically provide enough force to respond to a threat or harm against me. Usually, guns require little skills while handling and can be used by all individuals effectively.

Studies have shown that for robberies, the use of guns provided the most successful outcome to the victims of robbery. Also, people who possess firearms are said to be injured less or even lose property, unlike those people who used other forms of weapons to protect themselves. This, therefore, is evidence as to why it is morally right to own a gun for me.

Since it is legal to have a loaded gun in my car or any other place, it is morally right to have a firearm unless and until the owner of the property has no problem with that. However, despite that, the law allows that I can own a gun as long as I do not hurt the innocent I believe that it is not correct morally to have a weapon that is loaded in a property where the owner does not want that to happen.

In my view, employees do have a moral right and a legal right to have guns in their cars in the parking lot of the company that they work for as long as the law allows it. Employees need to protect themselves from criminals of murder and theft, and the only way that they can do this is through the uses of a weapon (Shaw, 1, P. 312). Since guns have been seen to be more effective due to their easiness to use, they are appropriate for employees. For example, Some employees are forced to work long hours in their workplaces where they go home late at night, and they thus need protection for their lives.

The law allows employees to carry guns to their workplaces, and employers could act unlawfully if they prohibit employees from having guns in their cars while at work. In my opinion, as long as the firearms are permitted and are kept away from the view of other people who could use it to harm others, I believe that guns should be in the cars at workplaces and it is also morally right.

However I do believe that it is not moral to carry guns for employees at workplaces where the employer does not allow guns to be carried because basically while an employee joins an organization they agree to abide by the terms and conditions stipulated in the company’s constitution including possession of firearms at workplaces and would, therefore, be unethical to break the rules (Shaw, 1, P. 312).. I also believe that employees should not carry guns in their cars at workplaces where the employer does not allow it and is protected by the law, which permits them to forbid gun holding. 

An employer views carrying a gun at the workplace as a threat to other employees as well as a conflict to a working environment that is safe. Any employer, therefore, has policies in place in order to prevent violence in the workplace. I believe that employers should be allowed to make decisions regarding their properties and what they consider to be safe at their companies. They should have a right to protection against intruders as well as objects that violate their safety.

For example, if an employer does not like guns being carried at their workplace, they should be respected because as employers they have reasons to be concerned since any mishap that could take place in the company will be liable to the employer (Shaw, 1, P. 312). Employers protect employees from harm, and they are concerned about their safety because it has an effect on the productivity of the company. 

I believe that the legislature should not be involved in matters concerning the decision of the owners of the company regarding ownership of guns at the company’s parking lot or in the workplace as well. The state legislature has set laws that allow purchase and keeping of firearms and the same parliament also allow for the employer to make decisions regarding the matter in which the employers are given a right to forbid carrying a gun at the workplace. Usually, the workplace is the property that is owned privately by the company and therefore the company has the right to choose if it does wish to allow its employees to carry guns in their cars not only to keep them in their parking areas but also to the workplace. If a company chooses not to allow employees not to carry guns at work, then they should be allowed to implement the rules that they have set regarding the issue. 

There are situations in which the company can allow the employees to bring guns to work both at the parking areas and the workplaces. For example, in cases where the employees leave work late at night, or they commute from risky communities, the employer can allow employees to carry guns (Shaw, 1, P. 312). The employers have a duty to protect their employees from any harm that could affect them; this includes allowing them to carry guns to work if need be, and that is reasonable.

I believe that carrying guns at work do not automatically violate the rights of other employees to a safe environment, especially where the weapons are concealed. Firearms can be carried as long as they are kept away from people who can misuse them. However, if the company’s laws stipulate that guns cannot be brought to work, no circumstance reasonable at all can any employee be allowed to carry guns at work.

Security and a right to life go hand in hand. An individual has a right to life, which requires that they are safe from any danger whatsoever. I believe that individual is entitled to hold a gun in order to protect themselves since guns are not only easy to hold and use, but they are also the best weapon compared to others such as knives and sticks in terms of reliability, effectiveness, and efficiency. I also believe that employees should be allowed to carry guns to work as long as the company in which they are working for allows and they have a legal right to do so. However, it is not morally right to carry a gun in an environment where the employer does not allow that, and the law supports it. 

For all companies and property owners, the act of minimizing their liability in the future brought about by employees and renters carrying guns is among their main goal. Developing policies is the best way to do this. The policies developed should be clear, simple, and should condemn all acts of violence. The policies should stipulate the actions that should be taken in case of violation and the resources that are available when someone feels threatened.

Companies that seek to prohibit employees from carrying guns to work should ensure that the rules it sets comply with the laws of the state. The legislature should not be involved in the decision concerning carrying a gun at work as long as the employer complies with the laws of the state and it should, therefore, leave it between the employees and the employer. The legislature sets the law and in some states in the United States guns are allowed at work, however where the law grants an employer the right to prohibit guns at the workplace or anywhere near the vicinity the legislature should stay away.
