After the evaluation of the entire case, I believe it would be an ethical and fair decision for Extreme Net management to allow Lopez to keep his job. If the company were to terminate Mr. Lopez at this moment, this would mean that we are going against his civil rights as he was utilizing his freedom of speech and expression when developing the website. Similarly, Mr. Lopez, if discharged from his duties, might take advantage of the decision by whistle-blowing against Extreme Net. From an ethical and legal point of view, since Lopez had voiced his concerns to his superiors who never gave any attention to his arguments, he has the upper hand in this case and thus it would be in the best interest of the company to allow Mr. Lopez retain his job at the moment.
Should the company attempt a lawsuit?
I don’t think this would be a recommendable step for us to take. Attempting a lawsuit forcing Mr. Lopez to neglect his website would expose much about Extreme Net. Similarly, it would appear very unethical and unfair to force someone to remove a website that he created to access his freedom of speech and expression; this is his rights which are protected by the law.

How the company can respect Mr. Lopez’s rights
The management of the firm has to remember that the company comes before anyone and thus its welfare must be protected and guarded. By allowing Lopez keep his website and his job with the company reflects that we are respecting his opinion and ideas, but at the same time we are reflecting the corporate dignity and control over the situation. Therefore, we can only respect his rights by allowing him to keep the website and at the same time not fire him.

Extreme Net’s management should first schedule a meeting which will involve the management and the employees’ body and have a discussion over the matter where the employees will raise their concerns, and we will try to listen and accommodate the ones we think are fair and ethical. By showing them we care for their welfare, we can be able to repair the relationship between the superiors and the employees. If the employees see and understand our aim of listening to their ideas and perceptions, they will work with their hearts and the objectives set will be easily met. The next time an employee has a complaint about the behavior of top management, we will first discuss it and sit down to solve it, instead of discarding the matter: an action which causes severe damage.
