Criminal justice is the system of enforcing criminal law. It is made up of law enforcements, courts and correctional facilities which work sequentially to identify and bring to book crimes and criminals. Transnational are crimes take place across national borders. These crimes thrive in the presence of weak criminal justice systems and weak legal structures. They present a threat to national and global stability. Transnational crimes have a complex organization. These include arms trafficking, drug trafficking, human trafficking, human smuggling and terrorism. They also include cyber-crimes, financial crimes. The crimes involve violence and physical harm. Over time, the perpetrators of transnational crime have diversified their areas of scope. This has had a great impact on the economy, human health and on the integrity of government institutions (U.S. Department of State, 2010) .
Human smuggling is one of the major organized transnational crimes. In its 2010 Fact Sheet, The Bureau of International Narcotics and Law Enforcement Affairs in 2010 estimated that Human smuggling networks facilitated the entry of approximately 90 percent of all illegal migrants from Mexico into the United States, earning an estimated $3 billion in profits. The people smuggled can be criminals, terrorists or fugitives. These individuals tend to be involved in violent activities in the United States. Therefore, they may end up hurting the American citizens. They also stretch and undermine the state security system. Further, the immigrants are more likely to be involved in gang activities. This has a detrimental effect on the security of the American people at large (National Security Council, 2020) .

Arms trafficking takes place through the black market. The weapons are mostly trafficked into the United States through ports and are mostly procured by terrorists and gangs. According to the head of UNODC, these “illicit arms fuel the violence that undermines security, development and justice”. They are the reason behind the increase in gang and terrorists’ activities in the United States. These gangs and terrorists’ groups not only harm people physically but also fuel terror among the United States people (National Security Council, 2020) .
