Social worker and their significance are undermined in courts. In the Jaffee v. Redmond the Supreme Court did not give professional social workers their due credit the judge questions the skills of social workers when it comes to counseling and compared social workers to family, friend, minister, and rabbi. This paper rebuts the judge’s apprehensions about the proficiencies of human service workers.
As depicted in Justice Scalia’s dissent in Jaffee v. Redmond; in Oklahoma, social workers are defined as professions who assist groups or people by enhancing their economic and social functioning hence improving wellbeing. According to ( Booth, 2014) “The practice of social work requires knowledge of human development and behavior; of social economic and cultural institutions and forces; and the interaction of all of these factors. Social work practice includes the teaching of relevant subject matter and of researching problems of human behavior and conflict ” Tit. 59, §1250.1(2) (1991). Based on the evidence provided by professional social work organizations, the court extended testimonial privilege right to social workers who have licenses. The function that social workers play in the life of the client is equally the same as those of licensed psychiatrists and psychologists or lawyers and therefore, they should be recognized in court similar to other professions.

Human service providers have a role that is defined in the criminal justice system. Social Work profession is capable of joining other professions who ensure there is public safety through preventing crime and addressing factors that will help reduce recidivism and reoffending. Unlike other licensed psychiatrists, psychologists and lawyers, social work professions are trained to deal with individuals who are ex-convict or ex-offenders: these individuals are termed dangerous, and they are likely to commit offense, this explains why the criminal justice system requires social worker to assume tasks such as advocacy, evaluations, intervention plans, referrals, and conducting assessments of suspected criminals ( Booth, 2014).
